NOTICE OF FORECLOSURE SALE Pursuant to the Findings of Fact; Conclusions of Law; Order Granting Plaintiff’s Motion for Summary Judgment and for Interlocutory Decree of Foreclosure Against All Parties Filed February 21, 2023, filed May 16, 2023 in U.S. Bank National Association vs. Vernon Fergerstrom, et al., Civil No. 3CCV-22-0000171, Third Circuit Court, State of Hawaii, the following described real property will be sold by the undersigned Commissioner at public auction on the date and at the time set forth below: PROPERTY DESCRIPTION: Fee simple property located at 33 Kaapuni Loop, Hilo, Hawaii. This 8,040 square foot property contains a 3 bedroom/ 2 bathroom residence built in 1976 (Tax Map Key: (3) 2-5-035-031). TERMS OF SALE: The property will be sold “AS IS” to the highest bidder, at public auction, with NO UPSET PRICE. The successful bidder is required to make a down payment to the Commissioner at the close of the auction in an amount of not less than ten percent (10%) of the highest successful bid price, and said payment shall be made in cash, certified check or cashier’s check. The down payment may be subject to forfeiture if the successful bidder fails to pay the remaining balance of the bid, fails to complete the transaction in a timely manner, or as otherwise ordered by the Court. The balance of the purchase price shall be paid in cash, certified check or cashier’s check to the Commissioner upon approval and confirmation of the sale by the Third Circuit Court and upon tender of the document(s) transferring title. The purchaser shall pay closing costs, including but not limited to costs of escrow fees, title insurance premiums, conveyance document preparation fees, accrued and unpaid real property tax, conveyance tax, accrued and unpaid ground rent payments, recordation and costs of securing possession after closing. Neither availability of title insurance nor securing possession of the property shall be a condition of closing. The subject property will be conveyed in fee simple by Commissioner’s Deed pursuant to order of the Third Circuit Court. The Commissioner shall accept the highest bid made at the foreclosure sale. At the Court’s discretion, the 10% down payment may be forfeited in full or in part if the purchaser(s) fail to pay the balance of the purchase price as hereinafter set forth. In no event shall the purchaser(s) be liable for damages greater than the forfeiture of the ten percent (10%) down payment. The balance of the purchase price shall be paid to the Commissioner upon approval and confirmation of the sale, provided that the Plaintiff may satisfy the balance of the purchase price by way of offset up to the amount of its secured debt if Plaintiff is the purchaser at the Commissioner’s sale. A further hearing shall be held in this action to consider confirmation of the Commissioner’s sale. In the event the Commissioner or the Court determines that it would be appropriate to reopen bidding in Court at the hearing to confirm sale, such reopened court bidding will be allowed on the condition that any such reopened court bid is at least five percent (5%) higher than the highest bid received at public auction. If the purchaser is a third party (not the plaintiff), the Commissioner shall open escrow at a licensed escrow company in the State of Hawaii to close the foreclosure sale of the property. The purchaser shall pay all costs and expenses of closing, including, but not limited to the following: costs of escrow fees, title insurance premiums, conveyance document preparation fees, prorated real property and conveyance tax, recordation and costs of securing property after closing. The inability of the purchaser to secure title insurance or financing shall not be condition of closing. The public sale may be either postponed or canceled by the Commissioner.
